What is RoHS?

RoHS stands for Restriction of Hazardous Substances in Electrical and Electronic Equipment. European Union laws have governed the use of hazardous substances in EEE, or electrical and electronic equipment, since 2003.

RoHS was designed to protect both the environment and human health by limiting the use of hazardous substances in products that have an electronic or electrical component. Many of these products end up in landfills as electronics break or become obsolete; therefore, the presence of certain toxic chemicals represents a real challenge to human and environmental health.

What substances are regulated under RoHS?

The RoHS Directive restricts use of the following substances:

  • Bis(2-ethylhexyl) phthalate (DEHP)
  • Butyl benzyl phthalate (BBP)
  • Cadmium
  • Dibutyl phthalate (DBP)
  • Diisobutyl phthalate (DIBP)
  • Hexavalent chromium
  • Lead
  • Mercury
  • Polybrominated biphenyls (PBB)
  • Polybrominated diphenyl ethers (PBDE)

These substances should not be present in consumer electronic devices, or devices with an electric or electronic component. RoHS sets out specific exceptions to that rule, as well as guidelines for how much of a substance must be present for it to run afoul of the law.

Which companies need to be RoHS-compliant?

RoHS regulations govern all products that have an electric or electronic component that are sold within the EU.

RoHS itself is enforced by member states. The burden of compliance rests on the company putting the product on the market. This means that the manufacturers of distinct components may not have to comply with RoHS directly. However, purchasers of those components will need detailed materials data in order to comply themselves.

However, even for companies wholly outside the European Union, RoHS compliance is often still relevant. If you want customers within the EU to have the option to import your product, you'll want to be able to give them the relevant information for their own burden of compliance. What products fall under RoHS regulation?

The regulation applies to all products that contain any electric or electronic component. This includes:

  • Cell phones and other mobile devices, including tablets and e-readers
  • Televisions
  • Laptops and PC computers
  • Appliances, both large & small

  • Radios & speakers

There are certain exemptions, such as certain military equipment and select medical devices. However, just because a product category was previously exempt doesn't mean it has remained that way. For example, medical devices as a category used to have a broader scope exemption than they do today.

How does RoHS relate to other standards?

Companies manufacturing and selling products have to keep multiple overlapping standards in mind. These can include California Prop 65, REACH, conflict mineral concerns, and more. While there is some overlap between RoHS and these other standards, just because a product complies with one set of standards does not necessarily mean it will pass muster for another set. Additionally, different authorities and regulations may require different types of authentication or documentation.

The history of the RoHS Directive
